ARCANE WARRIOR – PRO-FORMA INVOICE / QUOTATION TERMS & CONDITIONS (UAE – RETAIL CUSTOMER)

1. Validity
This quotation is valid for 14 days from the date of issue unless otherwise stated.
2. Prices
All prices are in AED and are exclusive of VAT unless specified. VAT will be applied as per UAE regulations.
3. Payment Terms
Payment must be made 100% in advance unless otherwise agreed in writing.
Late payments may be subject to additional charges.
4. Delivery / Collection
Collection is from DesertForge Offices
Delivery timelines (if applicable) are estimates only and subject to change.
5. Acceptance
This quotation is considered accepted once full payment is received.
Payment constitutes full agreement to all terms and conditions stated herein.
6. Returns & Claims
Any damage, defect, or discrepancy must be reported within 48 hours of collection/delivery.
Products must be unused, uninstalled, and in original packaging for return consideration.
Returns are subject to inspection and approval.
7. Warranty
Warranty (if applicable) covers manufacturing defects only.
Warranty does not cover misuse, improper installation, off-road damage, incorrect application, electrical faults due to improper wiring, or normal wear and tear.
8. Liability
The company’s liability is strictly limited to the value of the supplied goods only.
The company shall not be liable for indirect, incidental, or consequential damages, including vehicle damage, loss of use, or personal injury.
9. Ownership
All goods remain the property of the company until full payment has been received and cleared.
10. Installation Disclaimer
Installation performed by third-party or customer-appointed workshops is entirely at the customer’s risk.
The company shall not be liable for any damage, failure, or incident arising from improper installation.
Where installation is carried out at an Arcane Warrior Approved Mod Center, liability is limited strictly to workmanship of installation only.
11. Fitment & Compatibility
The customer is responsible for confirming vehicle compatibility prior to purchase.
The company shall not be liable for incorrect orders based on customer-provided specifications or assumptions.
12. Cancellation Policy
Orders cannot be cancelled once payment has been made and processing has begun for items in stock or for orders to be shipped.
Custom, special-order, or installed items are strictly non-cancellable and non-refundable.
13. Refund Policy
Approved refunds will be processed within 7–14 working days via the original payment method.
Shipping, handling, installation, and service charges are non-refundable.
14. Force Majeure
The company shall not be held liable for delays or failure to perform due to circumstances beyond its control, including but not limited
to acts of God, supplier delays, shipping disruptions, government restrictions, or force majeure events.
15. Product Use & Compliance
Certain products are intended for off-road or recreational use unless otherwise specified.
The customer is responsible for ensuring compliance with UAE laws, road regulations, and safety requirements.
16. Visual Representation Disclaimer
Product images, renders, specifications, and marketing materials are for illustrative purposes only and may vary from actual products.
17. Partial Deliveries
The company reserves the right to fulfill orders in partial shipments where necessary.
18. Storage & Collection
Customers will be notified once goods are ready for collection.
Goods not collected within 7 days may incur storage fees.
Goods uncollected after 30 days may be resold without further notice. Any balance (after deducting costs) will be refunded.
19. Electrical Components Disclaimer
All electrical products (including lighting systems) must be installed by qualified professionals.
Warranty will be void in cases of incorrect wiring, voltage misuse, or unauthorized modification.
20. Load & Weight Disclaimer (Roof Racks & Accessories)
The customer must adhere to the vehicle manufacturer’s dynamic and static load limits.
The company shall not be liable for damage caused by overloading, سوء weight distribution, or improper use.
21. Off-Road Use Liability
Off-road driving and overlanding activities carry inherent risks.
The company shall not be liable for any injury, damage, or loss resulting from product use in such conditions.
22. Governing Law & Jurisdiction
These terms and any resulting transaction shall be governed by the laws of the United Arab Emirates.
Any disputes shall fall under the exclusive jurisdiction of the courts of the Emirate of Dubai.
23. Special Order / Non-Stock Items Clause
Products that are not held in stock and are specially procured, manufactured, or shipped on a customer’s request (“Special Orders”) are strictly non-cancellable and non-refundable once the order is confirmed and/or payment is made.
This applies regardless of delivery timelines, shipping delays, or changes in customer requirements.
Refunds or cancellations will only be considered in cases where the product is defective, damaged, or not مطابق to agreed specifications, in accordance with UAE Consumer Protection Law.
25. Entire Agreement
These terms constitute the full agreement between the parties and override any prior discussions or representations unless agreed in writing.
